FRAMOS GmbH and its Managing Directors Bernd Franz and Dr. Andreas Franz, based at Mehlbeerenstr. 2, 82024 Taufkirchen, as the responsible service provider, would like to provide you, as the user of the service provided by www.framos.com (*.eu, *.de, *.fr, *.it, *.co.uk, *.ca) with information in a readily understandable form about the manner, the scope and the purpose of the recording and use of personal data in the context of using our web service and to provide you with information on the configuration options and rights that you have.
We naturally comply with the legal provisions of the German Federal Data Protection Act (Bundesdatenschutzgesetz - BDSG), the German telemedia act (Telemediengesetz - TMG) and other data protection provisions and we take seriously the consequent responsibility for protecting your personal data. We therefore wish to give you the following important information:
1 Personal data - how it is obtained and used, and how much
1.1. Data privacy relates to personal data. Personal data refers to individual data items about personal or factual circumstances of a particular or an actual person who can be determined, such as name, date of birth, postal address, eMail address, phone number or bank details.
1.2 We only obtain, process or use such personal data as is required to use or deliver our services, or such that you have agreed that we may use, e.g. in connection with advertising purposes, other forms of communication or web analysis Other than that we will only obtain, process and use your personal data if there is a legal provision to expressly permit or even require it.
1.3. In order to view the offers on our website and to gather information you are not required in principle to provide any personal data. If, however, you order any printed information such as our newsletter (ePaper) or have an individual query for us, we naturally require certain personal data in order to respond accordingly, to get in contact with you, and to be able to meet your needs. Such data may include your name, eMail address, postal address and, in some cases, phone number.
1.4. We also offer you the option of registering online for a password-protected customer account. The Customer Account section allows you to select specific products from our product range to form a kind of “wishlist”, in order to request a specific quotation or to view more detailed product information. In order to make use of this service, again personal data such as your name, address and eMail address must be obtained and stored.
1.5. When users visit our website, communication-related data (e.g. IP address) and use-related data (e.g. details of the start and the duration of the access and the telecommunications services you used) are generated automatically by technical means. In theory these technical means can allow conclusions to be drawn about personal data, but as a rule this is only possible with a considerable amount of effort. If your communication-related or use-related data is acquired, processed and used, it is therefore also subject to the legal data protection provisions.
1.6. With regard to the obtaining, processing and use of personal and/or communication-related data for the purpose of marketing analysis in the context of so-called social plug-ins, especially Facebook and Twitter, allow us to draw your attention to the detailed explanations below in Paras. 3. and 4. You can counter this by setting the relevant parameter in your browser or by not logging into your Facebook or Twitter user account.
2 The purpose of obtaining and using your data and sharing it with third parties
2.1. In principle we only obtain, process and use your personal data to the extent that we require it in order to deal with your enquiry about/order for our products, to respond to your specific enquiries or, if you specifically consent, to send you certain promotional information, in particular our ePaper; in detail:
2.2. Your personal data will only be shared with third parties to the extent required to deal with your order or enquiry. For instance, your postal address details must be passed on to the postal service provider who is commissioned to deliver the products or information that you have ordered. Such service providers must only use your data for the purpose of carrying out that delivery.
2.3. Beyond these purposes related to your order, your personal data will only be shared with third parties if you have provided your consent. As a matter of course we will never sell your data to third parties or market it in any other way.
3 Web analysis using Google Analytics and cookies
3.1 This website uses Google Analytics, a web analysis service from Google (Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA). Google Analytics uses so-called "cookies", text files that are stored on your computer to enable your use of the website to be analysed. The information generated by the cookie concerning your use of this website is generally sent to a Google server in the USA and stored there. In the event that IP anonymisation is activated on this website, your IP address will however first be shortened by Google; this applies to EU member states and states that are party to the Agreement on the European Economic Area. Only in exceptional cases is the full IP address transferred to one of Google's servers in the USA and shortened there. On behalf of the operator of this website, Google will use this information to analyse your use of the website, to compile reports on website activity and to provide additional services to the website operator related to website activity and internet usage. The IP address provided by your browser to Google Analytics will not be combined with other data held by Google.
3.2. We can use this non-personal information to tailor our website in line with the interests and focuses of our users, to determine the attractiveness of our website to users, and to improve its performance and content.
3.3. You can prevent cookies from being generated or stored by setting the relevant parameter in your browser software; however, we should point out that if you disable cookies you may not be able to use all this website's functions fully. Therefore you can also prevent the data generated by the cookie and relating to your website activity (including your IP address) from being acquired and prevent that data from being used by Google as follows: use the following link to download and install a browser plugin: http://tools.google.com/dlpage/gaoptout?hl=de.
3.4. If you are not using the configuration options mentioned in Para. 3.3, by using this website you are declaring that you agree to allow Google to use the data obtained from you in the ways described above and for the purpose stated above.
4 Use of Facebook (social plugin)
4.1. Our website features a built-in social plugin for the Facebook social networking application (Facebook Inc., 1601 Willow Road, Menlo Park, CA 94025, USA). Social plugins provide buttons, text boxes and notifications that a website such as ours can use in order to show you content from other websites (such as our company's content on Facebook) and enable you to have a social and personal experience when using the site. You will recognise these Facebook plugins by the familiar Facebook logos or symbols (the letter "f" on a tile with a blue background, or the "Like" button with its "Thumbs up" image). You can find an overview of the Facebook social plugins at: http://de-de.facebook.com/help/443483272359009/ . Although the buttons, text boxes and notifications are displayed on other websites, their content comes direct from Facebook. When you interact with social plugins you are sharing your experiences outside Facebook with your Facebook friends and others. If, for instance, you click the "Like" button on our website, those Facebook users with whom you share notifications in accordance with your own Facebook settings will be able to see that.
4.2. When you visit our webpages the plugin creates a direct connection between your browser and the Facebook server. This provides Facebook with the information that you have visited our site from your IP address. If you click on the Facebook "Like" button whilst you are logged into your Facebook account, you can create a link to our content from your Facebook profile. Facebook can therefore associate your activity on our website with your user account.
4.3. If you do not wish Facebook to be able to associate your activity on our site with your Facebook user account, then you should log out of your Facebook account before visiting our site, refrain from logging in, or not log into Twitter after clicking a button, text box or notification from Twitter and being prompted to log in.
4.4. As website provider we must point out that we have no knowledge of the content of the shared data, nor of how that data is used by Facebook. Further information on this topic can be obtained from Facebook under "Social plugins and data privacy" at http://de-de.facebook.com/help/340599879348142/ and in their "Data Use Policy" at http://de-de.facebook.com/policy.php.
4.5. By using this website in combination with the social plugins from Facebook you declare that you consent to Facebook using the data obtained from you in the ways described above and for the purpose stated above.
5 Use of Twitter (social plugin widget)
5.1. Our website allows you, with the help of a social plugin also known as a "widget" (see Para. 4.1 above), to share in real time the very latest information on our company with us and others within the Twitter information network (Twitter, Inc., 1355 Market St, Suite 900, San Francisco, CA 94103, USA), or to follow us on Twitter. Such Twitter plugins can be recognised by one of the familiar Twitter logos or symbols (e.g. the "blue bird" image). Although this button appears on our website, the content comes direct from Twitter.
5.4. If you do not wish Twitter to be able to associate your activity on our site with your Twitter user account, then you should log out of your Twitter account before visiting our site, refrain from logging in, or not log into Twitter after clicking a button, text box or notification from Twitter and being prompted to log in.
5.5. By using this website in combination with the social plugins or widgets from Twitter you declare that you consent to Twitter using the data obtained from you in the ways described above and for the purpose stated above.
6 Other social plugins (LinkedIn and Xing)
6.1. Our website also features social plugins from LinkedIn (LinkedIn Corporation, 2029 Stierlin Court, Mountain View, CA 94043, USA) and from Xing (XING AG, Dammtorstraße 29-32, 20354 Hamburg). The same principles apply to these as stated above in Paras. 4. and 5. Most importantly this means that these providers use cookie technology to obtain and process log data and data relating to your website activity on our site and third party sites as soon as you connect to their services/websites by clicking the associated button. Such data can be associated with your account if you are registered with these service providers with your own profile and are logged into that account at the time you visit our website. Depending on the way in which you use the social plugins from these providers, you will share further information with those linked communication and information networks, and that information may become public.
6.3 It is again the case that you should not log in or register your profile with these services before or during a visit to our website unless you are happy for LinkedIn or Xing to associate your visit with your profile/user account there. Furthermore, by using our website in combination with the social plugins from LinkedIn or Xing, you are agreeing to allow those service providers to use data they have obtained from you in the ways described above and for the purpose stated above.
7 Data retention period
We will only retain your personal data for as long as is necessary to execute and manage our existing legal relationship with you. Once your contract has been completely terminated and after the fiscal and commercial provisions have expired, your personal data will be deleted unless you have agreed to more extensive data usage, and as long as you continue to use a customer account that you have yourself set up with us.
8 Entitlement to information and retraction, unsubscribing from the ePaper, other configuration options
8.1. You shall be able to obtain information free of charge and at any time on your personal data that we have stored, its origin, where applicable any third parties with which that data has been shared, and the reason for storing the data (§ 13 Para. 7, TMG, § 34 BDSG). Under the provisions of § 35 BDSG you can demand at any time that your personal data be corrected, deleted or blocked.
8.2. Insofar as the usage, processing and sharing of your personal data by Framos GmbH depends on your consent (e.g. for advertising, marketing or market research purposes), you can withdraw your consent for the future at any time, without any need to provide a reason, by sending an eMail to firstname.lastname@example.org. You can also refuse any further use of your data where we are using it in a legally acceptable context, e.g. for advertising mailshots by post.
8.3. If you have subscribed to our ePaper (newsletter), you can of course unsubscribe at any time at https://www.framos.com/news-events/newsletter. At the end of every newsletter you will also find a link that will help you to easily delete your eMail address from our mailing list.
8.4. As regards prevention of the storage and use of the (anonymised or pseudonymised) data by Google Analytics, or of personal data in the context of the use of social plugins, we once again draw your attention to the options presented in Paras. 3.3, 4.3, 5.3 and 6.3.
